In downtown Victoria lots of restaurants vent pretty nasty smoke into windows of nearby offices and condos. Would a municipality actually have the ability to impose upgrades on a business that was established many years prior to redevelopment of nearby properties?

Well they enact anti-idling laws, no burn days/seasons, why wouldn't they want to do the same for restaurants. It is all pollution, and some of those restaurant fumes are pretty noxious. The technology is there to improve it.

Right, but I guess what I'm asking is if this particular bylaw is currently in place or whether such an upgrade would be requested on a case-by-case basis.

Burger King has been in compliance since it opened a decade or so ago and if these upgrades are more than a token amount I can't see a private business (it's a franchise, not a corporate store) dishing out thousands of dollars at the request of a developer or a municipality. The developer should be expected to pay for the upgrade considering its in their best interest, not the restaurant's.

^I agree with what you are saying but I would expect that if you get a building permit for a residential subdivision you should expect to have relatively the same conditions as any other subdivision. Unless there is some clause in the contract spelling out a probable nuisance you should be able to enjoy breathable air. I believe in Vancouver the city encouraged the restaurants to upgrade, and provided them with tax incentives to do so. The GVRD is responsible for monitoring air quality and controlling emissions from industrial, commercial and residential sources, so I would suspect the CRD? maybe has the same responsibility.

Having said that, if I was a developer/realtor trying to sell units I would offer to pony up at least some of the costs.

Popped into the showroom today and the sales rep took me up the hill for a site tour. Looks like a nice place and good view of the forest. The 2br/2ba suite I looked at was priced at $309,000.

Pricing seemed reasonable, but the quality of the finishings does mirror that. I suppose if you're not a snob like I am then it would be more than acceptable for someone looking for a nice condo to call home.


Unfortunately I'm not ready to pull the trigger, and for that price I could get a little hut at Kettle Creek. Smaller, but my own private little hut.

One of my clients moved in a few days ago. They are just finishing things up in the common areas and some of the units. Second building won't go ahead until they get more sales in the first. Decent bang for buck on the one bedroom units.

I really do wish the windows were larger. 

Anywho, that's just me. I'm sure the demographic that purcahase, it isn't a concern.
