Robbins Parking

...on Friday night I decided to take a few pix of a Robbins contractor immobilizing a car at a lot across from CRD HQ.
He didn't like it, so he decided to throw my camera out of my hands, then throw a few blows to my ribs to make his point.
Here's the guy:
Anyway, the police are investigating, and Robbins does not want to cooperate at all in finding out the situation.

Speak to staff at CRD Headquarters tomorrow and ask if a security camera points at the parking lot and whether you could receive a copy of the footage from that day. You may need a police file for that.

Well if your camera was snapping as the contractor was snapping then I would imagine that a trip to your favorite lawyer would result in you becoming a significant shareholder in Robbins!

You were punched by the employee? Did you call the police?

Yes, police attended. Although they tried hard to make me not take it further by suggesting that if I did make more noise, they would not just need copies of my photos, but they would need to take my phone (it's actually an iPod Touch) until trial. What a joke.

This couple I know do their banking downtown. Can't remember which bank it is, but it is on the corner with a parking lot next to it. You can park there for a short time for free. Can't remember the actual time allowed. They parked. Sue was laying down in the back of the car, Dave got out to go to the bank. He saw a tow truck, but as he was not going to be longer than the time allowed he didn't give it a second thought. As soon as he was in the bank, tow guy comes in for the kill. It was night time, so he got the shock of his life when Sue flashed a flashlight in his face and yelled at him. He took off so fast he was gone before Dave came back from the bank.

When you say Robbins is not cooperating what exactly have they done or said up to this point?
Btw, weirdie's reported experience with a Robbins Parking attendant that is linked above is really worth a read.

1. I don't understand one thing. If an assault takes place are the police not to supposed to make the final call on who assaulted whom based on physical evidence at the scene and/or witnesses, and lay charges? Clearly there appears to be a mark from a hand on your shirt, suggesting beyond reasonable doubt that a physical altercation took place, likely between a guy who just installed a greasy boot on a car and left a greasy mark on your shirt.
2. When you say Robbins is not cooperating what exactly have they done or said up to this point?
[/URL].
1. They took notes and told me they would go further if I wanted to. Up to me, but it was "his word against my word" etc.
2. Robbins told me point blank that they thought it was a bad idea of me taking photos, although they admitting to not know the law as to what was legal in terms of photo-taking in a public place. They have no interest in disciplining the employee or replacing my equipment.

The first photo you posted appears to have been taken from the sidewalk on Fisgard, yes?

You are legally allowed to take photos of anyone or anything so long as you are on public property or have the permission of the property owner when on private property.

I'm allowed to take photos anywhere that the public is invited to, including onto private property, as long as the people there do not have a reasonable expectation of privacy. Like a shopping mall etc. Anywhere the the public openly is invited to, and where I have not been expressly told not to frequent is OK.

Correct, there are 2 basic types of trespass on private property 'legal trespass' such as your mailman that can walk up to your mailbox and 'illegal trespass' the fact your mailman cant walk into your back garden to see you tanning in the buff!
Private/public spaces such as pay parking lots are different in that you are 'invited' to use the services as advertised, however you can be regarded as trespassing and escorted off the property if you are not partaking of the services on offer, i.e. you cant have a picnic or conduct business.....the line in the sand was this guy grabbing you and your camera....thats simple assault, Robbins should be all over this doing damage control....

Are you going to pursue this?
What's with the grease marks? Did he just have a McRib?

Were you antagonizing him in any way? It does justify the jabs you received, the guy was clearly a dick and deserves to be charged; but I would have just walked away the moment the altercation was born. Not worth it. The guy might have had a weapon or likely carried one in his vehicle.

Your other option would be to pursue civil action against Robbins for damage to your clothing and maybe personal damages, but it would take a lot of your time and some money that probably isn't worth your time.
Remember to say that this is "alleged" as Robbins could sue you personally for libel and defamation until its proven in a court of law.

You missed the part in between where you began shooting to the point where his fists were in your ribs.

He asked me several times to not take pictures. I explained several times that I was very well within my rights to take pictures. I stayed well back, he kept coming at me.
^ This is not "alleged". This took place.
