Vancouver Aquarium suing city and park board for banning captive whales, dolphins, porpoises
VANCOUVER — The Vancouver Aquarium is suing the city and park board over the 2017 cetacean ban for breach of contract and claiming it lost millions of dollars in revenue.

In May 2017 the Vancouver’s park board voted 6 to 1 to approve a bylaw banning whales, dolphins and porpoises in captivity.

The bylaw went into effect immediately, preventing the Vancouver Aquarium from bringing new cetaceans to its facility in Stanley Park.

A B.C. Supreme Court judge had agreed with the aquarium’s attempt to quash the park board bylaw and declared it void. But that ruling was overturned in February by a panel of three Appeal Court judges, who sent the matter back to the B.C. Supreme Court.

The Vancouver Aquarium says as the matter is currently before the B.C. Supreme Court, it is not in a position to provide additional details on the lawsuit.

I took the liberty of copying this account of the meeting written by a horse supporter because it goes into a bit more detail about each councillor's decision. 

 

This same person is claiming a dark blue Jeep has been driving around downtown this week aggressively cutting in front of the carriages and brake-checking them. The Jeep has a black convertible top and a spare tire cover that says "BAN HORSEDRAWN CARRIAGES".

 

Two idiots in front of me yesterday pulled out over the double-yellow on Belleville right before it turns into Blanshard to pass a horse and buggy.  

 

If we're worried about animal welfare, perhaps being a little stricter on passing could help?

I found it troublesome that Isitt dismissed any need for a actual public engagement on the issue saying that the statutory minimum would be sufficient as he considers the phasing out to be a "housekeeping matter...frankly", (COTW, May 16th, 4:06:30-4:07:42).  The e-carriage bit is a total red herring.

The Tally-Ho has been the cornerstone of Downtown tourism since 1903. No matter your opinion on the ethics of working horses Downtown, banning this business is a major move, not mere housekeeping. This is more complicated than just banning circus wild animals.

Could Isitt’s motion be the first step in elevating Jordan Reichert - the animal rights activist who ran for council in the last election and who last year was alleged to have placed fake out-of-business signage on a carriage company’s downtown carriage parking spaces - in the event Collins is elected as an MP and a by-election is called?

CFAX is reporting that the company that owns that Tally Ho horse tours will be taking the City of Victoria to court over the issue.

What's going to happen here is the same thing that happened when the City reneged on the zoning that permitted the Vic West marina. City of Victoria taxpayers paid out $1.6 million to Pacific National Investments back in 2005. The taxpayer also, naturally, incurred the costs associated with the City's legal fees.

every time this issue comes up.. and it seems to come up every couple of years.. they repeatedly say the horses are treated wonderfully and are well cared for, the horses vet has said the horses are treated wonderfully, and has even gone as far to say that pulling the carriages is GOOD for the horses.. the horses have special shoes to walk on the pavement,have access to their needs (water, food) and will do walks with no one in the carriage if they are standing too long between rides, they are treated well while on the street between rides, and the horses seem to enjoy the attention they get for being downtown (many people stop to pet them)

i really don't understand how 1 or 2 rare incidents suddenly leads to an all out ban (though this is the society that wants to ban plastic straws because 1 single turtle had one up it's nose)


Low hanging fruit. The current crew will never achieve anything in addressing addiction and homelessness, so they take they lazy, easy route to try and score points, while real life problems get steadily worse. If only there were compassion for humans as well as horses. M

Joking aside, I am a little surprised at how much Issit has misstepped recently.
