Victim shocked after Crown says no charges laid in dramatic multi-vehicle crash

December 16, 2020

After a driver fleeing police ran a red light a plowed into three other vehicles in the intersection of Bay and Douglas Street in 2019, the B.C. Prosecution Service says no charges are being laid.

The incident, which was captured on surveillance video from a nearby business, involved multiple vehicle and resulted in numerous people being hurt. One man who fled the scene was later arrested by police.

In a statement to CHEK News the B.C. Prosecution Service said Crown Counsel was unable to conclude that “the charge assessment standard was met” which are “whether there is a substantial likelihood of conviction; and, if so, whether the public interest requires a prosecution.”

Cheryl Hebert, a single mother who suffered a severe concussion as a result of the accident and has been off work as a nurse ever since, said she was shocked to learn that charges won’t be laid.

“I am shocked,” she told CHEK.

She has been relying on support services and her family and says she is confused on how someone who caused such a massive crash could walk away.

Michael Mulligan, a criminal lawyer at Mulligan Defense, said even though there is video of the crash, it isn’t always may not be enough to help with a conviction.

“Watching simply the video, you wouldn’t be able to determine certainty on a standard beyond a reasonable doubt who was driving the vehicle,” said Michael Mulligan, a criminal lawyer at Mulligan Defense.

“Let alone other issues on why that might have occurred. Was there something mechanical? or was there something medical why this accident occurred?”

But Crown is not releasing their reason.

Ryan Burghardt’s surveillance camera was the one that captured the crash.

After the crash, Burghardt and employees at nearby INA Motors gave Hebert a 2008 Hyundai Santa Fe. A handful of GoFundMe fundraisers were also started for her.

Burghardt says it’s very disappointing and concerning that no charges are being laid.

“You get into a big accident like that, never-mind the trauma it has caused. It’s hard to not see that closure, to say he is being held responsible for his actions, but no he just walked,” he said.

Hebert’s lawyers say they will be pursuing civil remedies once they receive full disclosure.

Victoria Police was also cleared previously by the Independent Investigations Office in the incident.

Downtown crash puts 1 in hospital 
 
VICTORIA -- One person was taken to hospital after a car struck a building in downtown Victoria early Thursday morning.

Victoria police responded to the corner of Yates Street and Broad Street at approximately 2:30 a.m.

A driver heading west on Yates made a wrong-way right turn onto Broad and struck the University of Victoria Legacy Art Gallery building.

Police say the driver was knocked unconscious and taken to hospital.

Investigators are looking at whether drugs or alcohol were involved in the crash.

Police are canvassing local businesses in the area to determine if there was a passenger in the vehicle who fled the scene.

I blame the Legacy Art Gallery building for not making its presence known to the driver.

the piece reads as if the “wrong way” turn was somehow a factor.

I blame the Legacy Art Gallery building for not making its presence known to the driver.

 

It's one of the more unpredictable buildings in downtown Victoria. It likes to catch drivers unawares.

The force field would normally stop a car dead in its tracks, not bounce it off to one side.

That would be seen as 'pro car'.  

 

Can we get a roundabout at Cook St and Dallas?  That intersection is a nightmare on a nice day, more so now that the Dallas Road dog park is all fenced in.

One person has died after a two-vehicle crash on West Saanich Road Thursday morning.

 

The Saanich Police Department is investigating a crash involving a full-sized pickup truck and a two-door car near Prospect Lake Road. The crash occurred at approximately 7:30 a.m. and traffic in the area is being diverted.

 

The other driver has been taken to hospital with non-life-threatening injuries.

“[It’s] a sad day for the community as lives lost on our roads is always upsetting,” says Saanich Mayor Fred Haynes. “It re-doubles my commitment to the pilot study to reduce posted speed on our residential roads to 40 kilometres per hour, and our other works to enhance the safety of our roads and intersections."

 
 
Of course Fred would use this to push his agenda.  First, this isn't a residential road.  Second - Leila Bui - Tanessa Nikirk didn't seem to care about the rules of the road.  
 
When you put too much faith into other people following the rules of the road for your own life and safety, things go wrong.

A logging truck has rolled just past West Shore Parkway on the TCH, northbound.

There are photos on our Facebook page. Luckily it doesn’t look too serious. Hopefully the driver is ok.

A witness says the truck ran a yellow and turned sharply onto the TCH, rolling over.

So much for these drivers being professionals. Running yellows and sharp turns at fast speeds sounds pretty amateurish.
