The Pineapple Express in Esquimalt has remained open all along. They have not closed down for even one day. Yes, this means they are taking a huge risk, this means they could never get their license approved by the government, and yes all of their product would be black market, and selling that comes with Massive penalties. But they seem to think it's worth it.


They will make more money in the next 6 months then they will in the next 10 years under the legal regime. Might as well run with it as long as you can if the police are saying that they will not enforce the law.

The law hasn’t been tested yet so I would expect there are some lawyers waiting for the opportunity to challenge its present structure. Our system is case law after all...

If you pay them enough money then many lawyers will represent you in whatever matter you want. Don’t know many who would advise you though to challenge the validity of laws the feds pass.

The Supreme Court of Canada has ruled unanimously that medical marijuana can be legally consumed in products such as cookies, brownies and teas, a decision that “outraged” the federal government but elated the baker at the centre of the case.

Federal regulations had previously stipulated that authorized users of physician-prescribed cannabis could only consume dried marijuana.

But the high court said in a 7-0 decision on Thursday that limiting medical consumption to dried pot infringes on liberty protections under the Charter of Rights and Freedoms.

“Across the country there will be a lot more smiles and a lot less pain,” said Owen Smith, a former baker for the Victoria Cannabis Buyers Club, whose 2009 arrest spurred the legal challenge.

Given all these strict rules, what should marijuana users do when questioned by border agents?

"That's a question I get a lot," said Chang. "It's a no-win situation for anyone who gets asked the question.

"If you admit to using controlled substances prior to legalization, you are barred," he continued. "If you lie and say you've never smoked it and they find out, it's a permanent bar for material misrepresentation, which is also quite serious."

Chang and Mason agree it's better to take a take a third, if imperfect, approach.

Delay.

"Refuse to answer the question. Say it's irrelevant. Say you don't know why this question is being asked," said Chang.

It won't get people to their destinations — and they'll merely be confronted with the same question next time — but at least they can consult a lawyer, he said.

That lawyer may even be able to resolve the situation directly with CBP "without you having to make an actual admission," said Chang.

"Because once you've admitted it, it's done. You're barred. Nothing anybody can do except apply for a waiver."

Despite the federal plan to restrict the minimum sale price of pot to $10 a gram plus taxes, looks like each of the provinces has been continually lowering prices. Ontario is now below $7 a gram including taxes on its least expensive products. http://www.ocs.ca

That's probably the only way to force the craft artisanal independent producers out of the market, initially.  I mean, it worked for Labatts and Molsons back in the day.  You are dealing a product that had an extensive home-grown infrastructure of supply to meet the demand, so charging premium rates out of the gate isn't going to make you competitive.

It should come as no surprise that the CoV's most left-leaning councillor wants this.

Victoria Coun. Ben Isitt is proposing to reduce the minimum distance required between cannabis retailers. The city had originally set the minimum distance between pot retailers at 200 metres but doubled it to 400 metres because of concerns about having too many shops....

Young seemed in favor of this as well. One of his arguments appeared to be that the current rules effectively blocked any business who actually waited for marijuana to become legal before setting up shop, because the quasi-legal stores already staked out their territory. That kind of makes sense.

Basically Young wants those who waited to apply for a licence until marijuana became legal to have first dibs on retail locations, and wants to send a strong message to those who set up shop prior to legalization to get to the back of the line. By reducing the distance between shops, he can give those who waited a chance to rent retail space, while pushing out those who did not.

Yes I am an Amazon freak but I was hoping to buy some tincture this afternoon to help my wife with a sleeping disorder.
