On 989’s homepage it states each suite with have both a storage locker and a bike locker . On the disclosure it states areas in parking will be marked Storage/Bike lockers ........ Developer will build enough storage lockers that each suite will have 1 storage locker . In reality each suite will have only 1 storage locker which may fit a bike probably not 2 . Most condo owners require a storage unit for suitcases , few storage bins , Christmas tree etc... So my question is has this Developer misled people who bought into there idea of the outdoor lifestyle mentioning biking paths showing people carrying kayaks when in reality there will be no bike locker only an area for 12 bikes in an outdoor area with around 200 units I think in the buildings .Just misleading or libel?

You can't mislead someone when they have the full description of what they are purchasing in the disclosure statement, and libel relates to making false statements about an individual, not a storage locker.

It's one thing to sign an agreement for one thing and then receive another... but if it says one thing on the website and another on the disclosure statement... well, with a stretch it might be misleading... but worthy of civil action... naw, nada, nope, not a hope in hell...

Victorians are generally pretty easygoing so I can't imagine anybody having a problem with folks carrying kayaks and canoes around via the bike lanes.

The website certainly says nothing about storing kayaks in the building, etc. They’re depicting seaside activities and outdoor activities that you can engage in nearby (like renting a kayak at Ocean River or MEC and playing around on the harbour). Do we really need disclosures now that not only warn you the coffee is hot, but if spilled could stain your shirt? Or that it will give off an aroma that you might be sensitive to? At some point common sense and personal responsibility have to kick in.

That being said, the website states on every page that the website itself is not an offering for sale and that such an offering can only be made through a disclosure statement. You can’t “not” buy a unit here without having the opportunity to throughly read the disclosure statement and once you sign you still have a seven day recision period to give you a chance to sleep on it, have your lawyer assess the statement, etc.

They're required to provide 214 bicycle storage lockers as per the zoning bylaw and the issued DP

I don’t have a legal or realtor background , but the webpage definitely states every suite will have a storage locker and a bike locker . From my experience in Condo buildings storage lockers are for junk type stuff and bicycle storage is generally a larger room for multiple bikes . So not really sure what the DP is or if the Developer is fulfilling the DP by having only a storage locker per unit .

They must be reading this thread because the website now only states that each unit will receive a storage locker, though you can see that it did say bike and storage locker when you go a Google search. Could have been a simple mistake that was never caught.

That all being said, the building plans clearly show that storage and bike lockers are one in the same.

One of the things that the city needs to prevent via the new parking bylaw. Building bike parking that is also storage almost guarantees it is not useful bike storage.
