“There is ample evidence before me that the bylaw (Rhodo) was considered by Council appropriately and is valid”

 

The judge upheld the zoning bylaw and dismissed the lawsuit in its entirety today. 

 

We are moving forward into building permits and construction  :banana:

True but not necessarily fully accurate. The court has limits on recoverable legal fees and what they assess is often only about a 1/3 to 1/2 of what a party may have actually spent on legal fees.

In my experience the legal costs that are recoverable have been a fraction of what I actually spent on lawyers.

Perhaps PPPDev can confirm if they actually got 100% cost recovery? As I said, I have never seen this happen as the costs that are recoverable are generally at the discretion of the court and in most cases well below what was actually spent by the prevailing party. This is especially true in cases where the loosing party can claim they represent the public good as this plaintiff attempted to argue.

Just watched one of the homes from this property go down Fairfield Rd. That takes a whole other skill of driving!

 

Anyone know where these houses are going? Think there are 3 of them.

Two houses, taken in 3 parts. One is going to Lopez Island, the other to Saltspring. The driver was super talented eh? Some of those pinch points were millimeters!

Someone posted that tweet on Facebook. It resulted in quite the tirade about Aryze from the guy who I think is the one who fought the townhouses. Seemed to be bordering on defamation. Might be another trip to court in the future!

This is the project that was originally going to be much darker, right? Not darker as in "the discussions on VV are getting much darker" but darker as in black/dark grey.

Today I realized I hadn't yet seen this project in its finished form. A balcony view overlooking a tennis court isn't quite the same as having a balcony view overlooking a golf course, but I could see myself enjoying it all the same.
