Mayor has said publicly on many occasions that the pot shop decision was made by the police chief and the police board.
If that wasn't true then I would have suspected that Del would have said something to protect the integrity of his force against accusations that they decide which laws to enforce.

I'm guessing ... but I do know that a roadway by definition is a "statutory right of way".
When private property is expropriated for construction of a highway or roadway (for example), it's done so by declaring it a statutory right of way.
Where they choose to put the median seems irrelevant, as it's inclusive of the statutory right of way ... or "roadway" by legal definition.
Of course that doesn't mean the cops themselves haven't rendered an utterly non-professional opinion themselves, that they would consider the median a fine place to panhandle from as it's not a "roadway" in the literal sense.
99% of the issues I have with cops in general is their highly selective enforcement of the law, combined with their seemingly endless drive to go about their business with the sole goal of hassling common citizens for traffic tickets, stereo too loud in your house (taxpayer), all the while ignoring panhandlers, tent cities, drug dealers, violent offenders, gangs, home invaders, and just general miscreants.

Cops hear this stuff all the time. I pull someone over for speeding, they tell me I should be going after the "junkies". Then I arrest someone for dealing crack cocaine, they tell me I should be going after the drunk drivers. I arrest someone for domestic assault, they tell me I should be going after the pedophiles. I write someone a bylaw ticket for a noisy stereo, they tell me that I should be investigating their neighbour for smoking pot. And on it goes...
A lot of people, when stopped by police, seem to have all these great ideas about what police officers should be doing. Oddly enough, their ideas never involve limits on their own behaviour.

Then I arrest someone for dealing crack cocaine, they tell me I should be going after the drunk drivers. I arrest someone for domestic assault, they tell me I should be going after the pedophiles. I write someone a bylaw ticket for a noisy stereo, they tell me that I should be investigating their neighbour for smoking pot. And on it goes...
A lot of people, when stopped by police, seem to have all these great ideas about what police officers should be doing. Oddly enough, their ideas never involve limits on their own behaviour.

I think Del is Helps’s whipping boy. Nice guy but weak. He’d never speak up to Helps. He doesn’t even seem to care about his officers getting assaulted by Helps’ award winning guests like those at Central Care home. . That’s why she got rid of Eisner and picked Del. Just my thoughts though...
If anything I think that she tried to keep Elsner around, at least until the point was reached that it wasn't possible anymore. She lied to the media about the existance of an investigation, badly handled (if at all), the complaints about sexual harrassment and 'unwanted touching' (also called assault), covered his legal fees, and kept him on payroll.

I haven't had a traffic ticket in 20 years.
I've never had a cop visit my place of residence in the 25 years I've lived there (or anytime before that is other residences I've had).
I've no criminal record, and my name appears nowhere in any police departments records.
So I will say with absolutely no baggage whatsoever that cops regularly apply an unbalanced, and often arbitrary interpretation and enforcement of the law, and do so often enough that it's a noticeable pattern.
I see it with my own eyes, and often enough to understand what it is I'm seeing.
As for limits on my behavior? are you kidding? ... I'm the life-long picture of the law abiding, tax paying citizen home owner ... not that it should be a requirement for my complaint to be heard and acknowledged.
Or are you implying that by posting a less than positive picture of law enforcement, and questioning what I see every day - that I'm somehow out of line, or my opinion isn't acceptable?
As for listening to the scanner, the internet makes listening to the CREST system easy ... and all that shows any taxpayers who bother to listen is exactly what they're getting for their tens of millions of tax dollars per year they're spending for law enforcement.
I'm not sure how getting what I'm paying for is supposed to then make me simply accept that police departments and police officers are utterly beyond criticism?
