Port Alberni man killed in stabbing pushed friend out of the way: ‘He saved my life’

Dec. 6, 2022 

Boyd Ermantrout was in anguish Tuesday, remembering the last moments of his friend’s life in a Port Alberni apartment last week.

“I haven’t stopped crying about it for four days. Like he was my best friend by far,” said Ermantrout.

That friend, named James, proved he felt the same way before he was fatally stabbed.  

“James pushed me out of the way. He said ‘I want you to be out of harm’s way, buddy,’ and he took the knife to the throat for me, and he saved my life,” he said.

It happened Friday night in an off-grid trailer park on Port Alberni’s 4th Avenue.

The victim, whose first name was James, was a 30-year-old man originally from Campbell River, according to friends. He was slated to move into tiny houses being built next door to the murder scene as a solution for those living in encampments.

Witnesses say he went looking for his stolen cell phone in a neighbouring apartment, which remained behind police tape Tuesday.

“They came to try to find their phone and they wouldn’t give it to them, and one pulled out a knife,” said a witness, who asked CHEK News to protect his identity.

“And the guy jumped up and stabbed him in the jugular. He didn’t stand a chance and then another guy went to grab him, to slow him down, and he stabbed him in the abdomen,” said Ermantrout.

According to Port Alberni RCMP, four people were stabbed, including the suspect, before officers arrived.

“Very shocked. At first I thought it was a rumour and then I heard it was confirmed,” said Cindy Stevens, the executive director of the Alberni Friendship Centre.

It’s a heartbreaking incident for Stevens, who is spearheading the new supportive housing project that James was so close to moving into.

“We’ve been honestly trying to get people into these homes for October 1st and that didn’t happen unfortunately, so now we’re looking at more like February,” said Stevens.

BC RCMP spokesperson Staff Sgt. Kris Clark said the events that led to the stabbing will not be released to the public at this time.

Prosecutors link escaped prisoner to Metchosin murder scene using DNA as trial continues

For the first time, prosecutors linked escaped William Head Penitentiary prisoner James Lee Busch to Martin Payne’s Metchosin home, where the 60-year-old was found dead in a pool of his own blood.

Busch is pleading not guilty to Payne’s first-degree murder.

Tuesday, a police investigator finally tied up a couple of loose ends in the Crown’s case.

Previously, the jury had heard of “male 1” and “male 2” who each had DNA found, alongside Payne’s, on bloodied clothing within garbage bags inside Payne’s bedroom.

Const. Donald Davidson confirmed Tuesday, male 1 was Armitage, and male 2 was Busch, connecting the blood-stained hiking boots, underwear and New Balance shoes found at the scene, to Busch.

It’s the first time prosecutors have been able to place Busch inside the crime scene. Up until this point, Busch’s defence lawyer Ryan Drury has highlighted the lack of forensic evidence placing Busch at the scene of the crime.

The New Balance shoes have been a point of contention throughout the trial. They’ve been connected by forensic investigators as a possible match to footprints in blood found in Payne’s bathroom near Payne’s body.

Drury has argued the lack of unique markings in the footprint means the print could have been made by any size 10.5 New Balance shoe of that model.

Davidson also testified that the keys found in the red and black MEC backpack found on Busch at the time of his arrest, worked on Payne’s truck and opened multiple locks on Payne’s home.

Crown also attempted to tie up another loose end in the abbreviated day: the note asking for the PIN number of a card found on Payne’s desk.

Busch’s defence had previously asserted that it was a failure by investigators to not have the handwriting analyzed, and because of that analysis’ absence, nothing disproved Payne from writing the note himself.

“There is no one who does handwriting analysis in Canada anymore,” Davidson told the jury, explaining why police chose to have it fingerprinted instead.

Fingerprints on that note came back as a match to Armitage, who escaped William Head Penitentiary with Busch at low tide in July of 2019, days before Payne was found dead.

'Despicable': Victoria man gets time served for antisemitic harassment

As part of his conditions, the 45-year-old man is not allowed to use a computer without parental supervision.

A Vancouver provincial court judge described a Victoria man’s unrelenting barrage of antisemitic, homophobic and threatening attacks on a Vancouver lawyer as “despicable,” as he sentenced him Tuesday to time served and two years’ probation.

Craig Millian Majorki, 45, had pleaded guilty to three counts of criminal harassment and spitting on a Saanich police officer trying to arrest him amid a torrent of “profane, derisive, homophobic and racist comments.”

Majorki, who has been ill much of his life and has endured more than 100 surgeries, was credited with serving 32 days in jail before the pleas were entered. He attended court via video from his parents’  Victoria home.

Judge Roger Cutler said the “abhorrent actions” and resulting trauma could attract “a lengthy period of incarceration” in the absence of mitigating circumstances.

The judge warned Majorki he would go to jail if anything similar ever happens again. “I hope you’re finding some means to control your volatility,” Cutler said.

Paul Sprackman had been Majorki’s lawyer on other matters, the court heard, and the abuse began after he withdrew from the role.

In a victim impact statement, Sprackman called the attacks “relentless,” done from afar by a keyboard warrior.”

In her victim impact statement, Jodi said Majorki called when her mother passed away and said: “I’m glad that ***** kicked the bucket.”

Asked if he had anything to say, Majorki said: “I’m just very sorry.”

His conditions include being supervised by a parent when using a computer.

The judge said if Majorki sends one wrong tweet or Facebook post during his prohibition period, “the police are going to be at his door and he is going to be in a cell.”

Majorki was put on a peace bond to protect Vancouver lawyer Chris Johnson.

Thieves smashed a window of an optical store in Oak Bay and made off with 40 pairs of glasses valued at $8,000, according to police.Oak Bay police responded to an alarm at the business in the 2000 block of Cadboro Bay Road at 4 a.m. last Wednesday. An RCMP dog team was dispatched, but no suspects were found.



A commercial alarm alerted police to the second sunglasses heist of the month in the early hours of Nov. 30.

A commercial alarm drew Oak Bay police to the 2000-block of Cadboro Bay Road shortly before 4 a.m., according to a department release. Officers arrived to find a smashed window and called in an RCMP police dog, which did not track a suspect. A Saanich police forensic team also examined the scene. About 40 pairs of eye wear frames, worth about $8,000 were stolen.

On Nov. 15, around the same time in the morning and the same block, a commercial alarm alerted police to a significant theft of sunglasses.

Victoria Police is looking to identify this suspect, who on November 18th, threatened staff of a local business in the 700 block of Government St.

The suspect was being escorted out of the premises when he threatened staff with a bike lock. Unfortunately, the suspect left the area and Police were unable to locate him after a thorough search of the area.

Port Alberni RCMP have arrested one man after the latest business robbery

Another business fell victim to robbery at 9:30 AM on December 6, 2022 as a man entered the store dressed in all black, his face covered by a balaclava. This is the latest in a string of robberies reported to the Port Alberni RCMP from businesses in the area.

Staff from a business in the 4100 block of Redford Street called police to report that the man had just ran off in an unknown direction.

Minutes after the suspect left the store, Police Service Dog Jammer, and his handler were on his trail and he was located just blocks away by patrolling officers.

This latest incident has many similarities to five others over the last week and half, stated Constable Richard Johns. Front line officers are working closely with our Forensic Identification, Crime Reduction, and Major Crime Units to determine if these robberies were carried out by one person.

On December 7, 2022 the BC Prosecution Service approved charges of Robbery and wearing a Disguise with intent on a 25 year old Port Alberni man, who has been remanded in custody for a court date later this month.

Should our investigation determine that this man is responsible for the other robberies more charges will be forwarded to the BC Prosecution Service.

Metchosin murder trial hears of ‘lethal’ stab, chop wounds

James Lee Busch is charged with the first-degree murder of Martin Payne

Dec. 7, 2022 

Martin Payne died from “multiple sharp and blunt force injuries due to an assault” in his home in 2019, the jury presiding over a Metchosin murder case heard on Wednesday (Dec. 7).

The jurors were shown graphic photos from Payne’s autopsy as an expert described what caused large bruises and gashes where the body was stabbed or chopped at.

Steven White, the B.C. coroner service’s lead forensic pathologist, examined the 60-year-old’s body and performed the autopsy. He testified on Wednesday as the Crown’s culminating witness after three and a half weeks.

Payne was stabbed through the front right of his neck with the sharp object that sliced through his corroded artery and jugular vein on both sides, along with his trachea before the object exited on the left side of his neck.

“This would’ve been a lethal injury, definitely, because it cut off blood supply to the head and the deceased was inhaling blood as well,” testified White, who was qualified by the court as an expert in the causes of injuries and deaths.

The neck wound was one of the five “sharp force wounds” – ones where a sharp edge cleanly cuts through the skin and tissue – sustained by the Metchosin father. Those also included an 11 cm-long gash on the back of Payne’s neck. He was also stabbed 10 cm into his body near his left shoulder. The latter wound’ve had to come from a blade slimmer than the bowie knife, White said.

The court saw bloody images showing where multiple chop wounds to the victim’s head caused the bones to completely separate – exposing what White called the lining of the brain – or where the skull was hanging open. Chop wounds are ones by an object with a sharp edge that’s also heavy enough to cause blunt force injuries.

“All four of those chop wounds to the head would’ve caused injury to the brain, in the form of bleeding around the brain and swelling of the brain,” White said.

Payne would’ve been alive when he suffered the chop wounds and when he was stabbed through the neck, White testified.

Payne also suffered eight blunt force wounds, including contusions to the head, lacerations to the arms and more bruising on several parts of his body.

Wednesday marked the final pieces of evidence being presented in the trial, which will resume on Monday in Vancouver.

Senior charged in death of Saanich teen in crosswalk crash

A driver has been charged a year after a Saanich teen was killed while walking in a crosswalk.

Kaydence Bourque, a 16-year-old student at Reynolds Secondary, had just gotten off the bus on Dec. 6, 2021, when he was struck by a vehicle.

He was less than 100 feet from his home near the intersection of Cedar Hill Cross Road and Merriman Drive when he was struck, according to a Facebook post at the time from his mother, Crystal Bourque.

Now, Margarita Citron, 72, has been charged with driving without due care and attention.

Bourque wrote at the time that her son never regained consciousness and was pronounced dead Dec. 7 at 4:20 p.m.

“I can’t believe this is the last time I will ever be able to hold his hand or kiss his head. Our hearts are broken into a million pieces. He was so incredibly kind and loving,” she wrote.

It could have been worse. He might have tried to steel someone's mail from Christmas Ave on Christmas Eve.

 

I can forgive a thief who steals Christmas gifts from Christmas Ave. on Christmas Eve, but if he neglects to follow through with the theme and hide out on Christmas Hill for at least a little while then I say throw the book at him.

It would appear so.  And/or maybe because he would not give up his credit card PINs.  As I have seen no evidence they used his cards.

Victoria police are asking for public assistance in their efforts to find two men who sexually assaulted a teenage exchange student Tuesday morning in Topaz Park.

 

The girl was walking through the park between 9 and 10 a.m. when her path was blocked by two men in the area of the fieldhouse and washrooms, near Finlayson and Glasgow streets.

The two men are described as both being approximately 60 years-old. Both men had dark hair and were wearing dark coloured clothing consisting of black shirts, black pants and black shoes. Both men were carrying large black backpacks and, according to the girl, had a disheveled appearance.



The incident occurred in the area of the Topaz Field House and Washrooms

The incident was first reported to police in the evening of December 6th, and officers were first able to interview the girl last night, as her parents reside in a different country. The girl has been connected with supports.

This investigation remains active and officers are working to identify and locate the suspects.

Investigators are asking anyone who has surveillance footage from the area, or who witnessed the incident, or who recognizes the description of the two suspects, to call the VicPD Report Desk at (250) 995-7654 extension 1.
