Killing seagulls is not allowed, except under extremely specific conditions, yes.
However, there are eminently practical, modestly priced, low-hanging fruit, practices, which can minimize the deleterious consequences of annual gull infestation. There is also a directly related potential for sickness of the human occupants of the building. Often nests are constructed directly below rooftop HVAC air intakes. Resulting in, not only the unpleasant fumes being distributed widely throughout the building, but also the germs, spores, viruses, and assorted cooties, produced by the rooftop Larus occidentalis.

In truth, and of course not an encouragement for anyone to do so, killing seagulls, egg breaking, nest removal, is actually only, in terms of consequences, illegal, should you be caught and found guilty. Apart from that, it's a completely wide open field. Hypothetically speaking.

‘Two years of hell:’ Nanaimo property declared nuisance due to loud music, ‘blinding’ floodlights

NANAIMO — Songs playing loudly on repeat for hours, profanities and insults shouted day and night, and multiple floodlights permanently activated have led to a nuisance property designation for a central Nanaimo home.

The actions of the tenant living at 2212 Meredith Rd., located in the Northfield neighbourhood off Bowen Rd., were described by City bylaw officers as an “attempt to threaten, agitate, demoralize and rob neighbours of peace.”

A neighbour who lives adjacent to the nuisance property, told NanaimoNewsNOW the trouble with the occupant began shortly after he moved in.

“It was two years of hell. He’s bats*** crazy. Having to listen to music…the same song (Beautiful Day by U2) on a loop for seven, eight hours a day.”

The neighbour, who requested to remain anonymous, said the man would yell remarks such as “don’t lose any sleep” and “have a good night everybody” and profanities after playing music loudly outdoors, sometimes until 3 a.m.

Neighbours say the floodlights at 2212 Meredith Rd. have been on 24/7 since the tenant moved in, with additional lights activated by motion sensor.

“He lets his car alarm go off at 2 or 3 or 4 o’clock in the morning, and he does it over and over and over again,” said another neighbour. “He does it on purpose I’m quite sure.”

The Nanaimo RCMP have been contacted at least three times, but have not taken any enforcement action at the property.

Barry Greening, operations manager for Mayfair Shopping Centre, which is responsible for the shopping plaza where PENN is located, said the noise device was installed to address safety issues caused by loiterers since Muncey Place, which is owned by B.C. Housing, opened in 2020.

 

He said the device, called a Mosquito, has been “reasonably effective” in deterring people, adding he has not heard anything from bylaw personnel regarding its use.

 

Greening said the threats to safety outweigh the effects of the high-pitched sounds. He said cleaning costs have quadrupled and security costs are six times what they were before Muncey Place opened. “I feel that the disturbance caused to me by B.C. Housing would probably exceed any disturbance that I have to them.”

 

He said he wants to see more support from the city and housing agency to deal with what he described as an ongoing issue for staff and ­customers. “My intention is not to reduce the noise-emitters,” he said. “My plan is, if anything, to install more to create more of a deterrent.”

These things are awful. There’s one at the Bay Centre at the corner of view and broad street and I can hear it at my home at night which is blocks away. Tough to sleep with the windows open

Ah you young kids, I feel sorry for you. I had one in my front yard to try and stop the deer from eating everything. It was marginally successful at that but it did stop the kids playing basketball in front of my place, big win.
