The mother of the former boyfriend of Lindsay Buziak has launched a defamation lawsuit against the slain realtor’s father, marking a stunning development in one of B.C.’s highest-profile unsolved murder cases.

Legal counsel for Shirley Zailo filed the notice of civil claim in B.C. Supreme Court on April 25 and names Lindsay’s father, Jeff Buziak, as well as Vancouver resident Jane Kavanagh, as defendants.

The lawsuit alleges that Kavanagh, using online aliases, published “defamatory” comments on a blog website owned and operated by Jeff Buziak.

On one post made by Jeff on June 14, 2019, Kavanagh allegedly published false comments implying that Zailo — whose son Jason dated Lindsay prior to her murder — killed the realtor, planned her murder or participated in her killing, Zailo’s lawyers claim.

In another post made Dec. 5, 2019, Kavanagh allegedly implied, falsely, that Zailo was a “psychopath,” that she was “jealous of Lindsay’s youth and good heart” and planned and executed her murder, according to the lawsuit.

The lawsuit details subsequent posts allegedly made by Kavanagh implying that Zailo had a hand in Lindsay’s murder and “bought” off members of the Saanich Police Department.

In each instance, lawyers claim Jeff Buziak jointly published, or arranged to have published, Kavanagh’s posts, saying he was aware of the defamatory words published on his website and that he not only failed to remove them but also “encouraged people to publish words defamatory of the plaintiff.”

The claim states that Zailo has suffered loss and damages to her reputation, loss of income, stress, anxiety and other mental suffering as a result, and is seeking an unspecified amount in damages as well as an injunction against Jeff and Kavanagh to prevent them from publishing further defamatory statements.

Zailo has also filed a separate defamation lawsuit against Chilliwack resident Nora Leisa Munro, alleging that she also published defamatory comments on Jeff Buziak’s website usin g fake names.

As I said in another thread. Dozens of people have been murdered on the Island in the last 15 years. Many cases remain unsolved.

This dad is making it his life mission to try to get to the truth.

Can’t blame him.

I support J.B. 100% in his tenacious and relentless pressure on law enforcement for results in the investigation of his daughters murder.

I also find his continued questioning of those associated with his daughter at the time of her murder most appropriate (especially those whose cooperation with law enforcement has been less than helpful).

 

Some folks choose to see obsession in J.B.'s actions, but realistically his statements and actions demonstrate that his father/daughter bond with Lindsey remains fundamentally unbroken.

Agreed. The point though is that if you start publicly claiming that people are criminals then you have to expect that they react. The onus is not on them to prove there are not criminals but for you to prove that they are!

I don't think Jeff is doing anything more than prodding all of those involved into some sort of action.

That could mean he's prodding the Saanich PD, or any/all of his daughters business and personal associates at the time of the murder.

 

His claims aren't particularly focused on claiming that these folks are outright "criminals", but that they potentially know far more than they've shared with the Saanich PD.

Guilt by association at the least, personal involvement at the most.

 

His current premise likely being that any action at all (regardless of what it might look like) is far, far better than the "no action" that has plagued this case for years now.

The mother of Jason Zailo, who was the boyfriend of real-estate agent Lindsay Buziak when she was murdered in 2008, filed a civil claim in BC Supreme Court on April 25 alleging she had been defamed by three people. The people she’s suing include Lindsay’s father, Jeff.

The allegations have not been proven or tested in court and the defendants have not yet filed a response to the civil claim.

Now Shirley Zailo, 68, and her two sons, Jason, 41, and Ryan, 39—who are not named as plaintiffs in the lawsuit—have given Capital Daily exclusive new interviews about what they describe as relentless online attacks on lindsaybuziakmurder.com, a website allegedly owned and operated by Jeff Buziak.

Ryan and Shirley are employed as real estate agents for Remax Camosun. Jason is a mortgage broker for Dominion Lending. Buziak, 67, is a commercial real-estate agent, currently living in Alberta. He hosts an annual memorial walk through downtown Victoria in an effort to put pressure on the Saanich Police Department (SPD) and keep public attention on his daughter’s case.

“We’re not trying to stop Jeff from finding Lindsay’s killers,” Jason Zailo said in his first major interview since 2010. “We’re just trying to stop the lies and people calling our family murderers when it’s not true.”
 
In a phone call with Capital Daily, Buziak said he was learning details about Shirley’s lawsuit for the first time, but that he often receives threats of lawsuits and was not surprised that Shirley had named him in a civil suit.

“Shirley has been one of my biggest enemies,” he said, portraying the Zailo matriarch as the aggressor and saying she had not cooperated with him in trying to solve Lindsay’s murder. About the allegations in Shirley’s claim, Buziak denied he published or arranged to have published any defamatory comments.

Family and supporters of a Greater Victoria realtor murdered 15 years ago this coming Thursday are taking to the streets for the 13th time to demand justice in her killing.

Lindsay Buziak, a 24-year-old real estate agent, was fatally stabbed in a second-floor bedroom of a home she had arranged to show to what she thought were prospective buyers in the Gordon Head area of Saanich on Feb. 2, 2008.

More than a decade later, the case remains unsolved.

“Unfortunately, the country, province and Saanich are letting everybody down,” her father Jeff Buziak told Black Press Media. “My daughter was murdered. The killers are walking free in the community and women are scared. That’s the reality.”

Buziak, who lives in Calgary, is still searching for answers.

The 68-year-old father returns to the capital region each year for the walk from Saanich Municipal Hall to the B.C. legislature. He’s been highly critical of the way authorities have handled the case, even suggesting that Saanich police have fumbled their investigation.

In 2021, Saanich police assembled a new task force with assistance from the RCMP and FBI to investigate the case, which they said would make use of new DNA and genealogical technology.

Still, Buziak says there isn’t nearly enough progress being made on his daughter’s unsolved murder.

This year’s walk begins at 10 a.m. on Feb. 2 at Saanich Municipal Hall. Jeff says all are welcome whether they knew Lindsay or not.

In the true-crime era of The Staircase and Serial, “the boyfriend did it” has become a kitsch-worthy slogan. To some, Lindsay’s case is no different. For the last decade-and-a-half, Jason Zailo and his family have been repeatedly portrayed as potential villains, despite the Saanich Police Department (SPD) announcing, as early as February 2009, that Jason was “not a suspect.” (The SPD declined to comment for this story.)

 

“It’s like a movie I watched, but I can’t seem to get out of it,” Shirley, 67, told Capital Daily. “But unfortunately, we’re in it. We are the characters.”

 

Until now, accounts of Lindsay’s murder have largely been driven by her father, Jeff Buziak, who has been among a few people close to Lindsay willing to speak publicly. In Jeff’s telling, Jason Zailo’s mother Shirley was a controlling and overbearing presence in Lindsay and Jason’s relationship, and purchased and renovated a lakefront house for the couple to move into. Jeff has also said that Lindsay told him she saw something “she shouldn’t have,” a claim that appears in many true-crime versions of Lindsay’s murder.

Hi Missy, I would like to clarify a few things if I may. :)  The retired RCMP detective (Garry Rodgers) did not take all his blog material from the Murder In Saanich website. He interviewed a large number of people and did his fact-checking which resulted in his conclusion on whom he believes is involved in Lindsay's murder. He does not believe the Zailos are involved and I agree with him. There is no evidence to support the Zailos were involved.   Furthermore, Garry wrote his blog page about Lindsay's murder in his own words. He did not copy and paste any blog content from the MIS website as you falsely claim.  I do however have website data evidence that shows the author of MOD copied every single page of the Murder in Saanich website to her PC.
 
As for the Calgary drug bust timeline, that timeline was constructed based on hours and hours of meticulous research (from court transcripts, court documents, media releases, police statements, etc). The facts were then pieced together to formulate a tight timeline that aligned with the timeline of Lindsay's murder (SP constructed the murder timeline).  The full page of the Calgary timeline was constructed by the author of the MIS website and that timeline is not on "many other sites" like you claim. The author of MOD copy and pasted the entire contents of the Calgary timeline page, along with other content, to her blog, and falsely claimed she wrote it. She also copied blog content from two other websites 1) Garry Rodger's previous blog page "dying words Lindsay Buziak Murder" and  2) the LBM website.  
 
Garry Rodgers posted information about his thoughts surrounding the real informant in the Calgary bust. The author of MOD copied and pasted Garry's thoughts to her blog, then falsely claimed no other blog had ever discussed the "real informant" topic.  I don't blame Mr. Rodgers for deleting his blog page about Lindsay's murder.  He was thrown under the bus by someone he trusted and then the names of some of his confidential sources were made public.  He was a good guy who had good intentions and he didn't deserve that.
 
An excerpt from Garry's previous blog:   "What I can say about Lindsay Buziak’s murder is that I may not be able to truthfully write the public story as the circumstances now sit. I have a lot of information about this awful mess, the motive for the crime and, with probable certainty, who the conspirators are. If I publish what I’ve learned and what people close to the story have candidly told me – to tell the truthful and accurate story – I might compromise an active police investigation and that can not happen."
 
"What I can say about Lindsay’s case is she was a totally innocent victim of an elaborate conspiracy to frame her as a police agent. That was to cover up and protect a real police informant who double-crossed an arm of the Sinaloa Drug Cartel in a multi-million dollar cocaine loss. Yes, the story is that involved and complicated. I will also say, with probable certainty, the two people directly involved in stabbing Lindsay to death are a Mexican brother and sister pair who are now long gone from Canada. However, the co-conspirators who fed Lindsay to the killers are still active in the Victoria area." 
 
"Saanich Police are also on the record that Lindsay Buziak was not directly involved in the cocaine ring and was never a police informant. They do, however, publicly state they believe Lindsay may have been mistakenly, or intentionally, identified as the real informant(s) in High Noon who turned in Erickson Delacazar and caused a domino-effect 67 kilo product and $2.227 million financial loss."
 
"Far worse, for the Sinaloa and emerging Beltran-Leyva Cartels, was a security breach. Saanich detectives indicate support for the theory that whoever financed this cocaine funneling—and took a significant loss—ordered a hit on someone to set an example. That someone was Lindsay Buziak."
 
"Lindsay’s death, they theorize, was intentionally directed at her. However, the Saanich Police state Lindsay’s killing was likely a case of mistaken informant identity or an intentional diversion away from the real informant(s) causing the massive financial loss to an individual or a group. Like the Saanich detective says, “They needed to solve a problem. Lindsay was the solution.”
 
Lastly, there is zero evidence to support ALL the Zailo content on MOD is ALL accurate. In a court of law, you need evidence. Repeating gossip that is not even relevant does not constitute evidence.  As for Rianne, she may have said a few things to a few people in an email/text, but the rest is all hearsay.  I don't believe Rianne said 99% of the things people claim she told them.  It's just someone telling you that someone else told you that.

Justice for Lindsay Buziak walk returns on 16th anniversary of Saanich woman’s murder

On the 16th anniversary of Lindsay Buziak’s murder, her father led the annual march calling for answers in the case.

“This is 16 years since Lindsay was murdered, the 14th time, I believe, we’ve participated in this walk as a reminder to authorities that Lindsay’s murder is unsolved – and also to remind the community that the conspirators and the killers of Lindsay are still at large in the community,” said her father, Jeff Buziak.

This year, supporters gathered in front of the Saanich Municipal Hall before beginning their march.

“[Police] will tell you they investigate it all the time and it’s active. We’re 16 years and nothing’s happened, so to me it feels like nothing’s being done,” said Jeff.

Saanich Police Chief Dean Duthie says the police department is still on the case.

“It’s a tough thing for me to talk about because my heart goes out to the family, and I know that answers are desperately wanted,” he told CHEK News on Thursday. “All I can say is we are doing everything we can, as we have throughout this lengthy period of time to find these answers.”

Jeff adds that he hopes realtors are aware of his daughter’s murder since the real estate industry is booming and her death occurred while she was on the job.
