Well, since this thread is revived there is a $1m building permit for alterations to Danbrook by a vancouver architect firm. So it looks like they may have found a way to rectify the issue. 

 

Building permit or demo permit?!

What did Langford say at the time, differences of opinion between engineers or something similar and that they were just being nice by giving $400K to the tenants?

IIRC, Centurion purchased two other buildings from DBS as well.

The owner of an 11-storey residential rental building in Langford that has sat mostly vacant for a year and a half since the city revoked the occupancy permit is suing the seller, builder, structural engineer and engineering firm, and the City of Langford for what they claim is negligence causing dangerous defects in the building.

Toronto-based Centurion Property Associates bought Danbrook One at 2766 Claude Rd. in late August 2019 and began renting the units.

Capital Daily has obtained the third-party review of Danbrook One from the City of Langford. The review was conducted by WSP, an independent engineering consulting firm that was brought on in December 2019, after Langford was informed by the Association of Engineers and Geoscientists of BC that the condominium was structurally unsafe. 

 

In the 19 months since the building’s potentially catastrophic shortcomings were identified, Danbrook One, Langford’s tallest building, has been sitting empty— but a flurry of activity has been taking place behind the scenes.

 

The current owner, Centurion Property Associates, has launched a lawsuit against engineering firm Sorensen Trilogy Engineering Ltd; its lead structural engineer on the Danbrook One project, Brian McClure; the builder, DB Services; the seller, Loco Investments; and the City of Langford.

 

According to civil court documents from October 2020, Centurion demands to recover costs of at least $1,000,000 for remediation work on the project, plus the rental income that was lost after the building had to be evacuated in December 2019. 

 

Centurion claims they’ve lost around $200,000 per month from rental costs alone.

News articles mention a "comfort letter" given to the buyer by Langford. 

 

I didn't know what the term meant so I looked it up.

 

It now appears to me that the buyer asked Langford the standard questions but because Langford knew about the problems they very carefully drafted a comfort letter that skirted the real issues.

So it seems these letters can be a legal minefield of liability and both parties are very cagey about what information they release.

because that's what responsible governments do.

 

they try to help the process along rather than saying "you'll need to check with each individual department and get all the documents yourself".

 

then they just charge a fee for it - for cost recovery - and it's a good process.

 

the information given is somewhat limited.  the documents are not attached but they let you know if there are any.

^ Those are letters for issues controlled by the City (ie zoning). I guess we will have to wait to see what Langford provided comfort on. If it was just zoning then I am surprised that they were added as a party.

Yah there are a host of things that can be in a comfort letter depending on the request. For example it might confirm the date of final BP inspection, the date and file number of building or development permits issued by the City, active business licenses, stop work orders...

Richmond does about three or four each week by my estimate.

They're probably going to rebrand. I bet the first demo move will be taking down the sign. In the future, one neighbour will say to the other, "you know this is actually Danbrook One, right?" "WTF?!"
