Hmmm, saw LOTS of businesses closed today downtown, that really, I'd expect to be open. Smoken Bones closed for the whole day, what kind of restaurant closes for stats? Machiatto Juliet closed. Shine, Pig, Yates Taphouse all with limited hours.

Is that a sign that they enjoyed a much-needed break, and could afford to close - or that they are doing so poorly this time of year that they can't afford the extra staff costs?

One Sidney business:

Where were all the businesses in Sidney today? Closed!
The town was full of people and we were overrun with customers.
What a lost opportunity! Customers asked us why is everyone closed.
Oh well we profited.

With regard to wages, the stat gives your employee, full or part-time, an average day's pay for the stat automatically, and working it means 1.5 times the pay, plus a paid day off in lieu. I don't know... in what is already a short month, can business afford to take in zero income, when they still have the same fixed costs (rent, insurance etc.)?

Closing on a stat could make sense if your business relies on office traffic. The few people coming downtown to visit your establishment on a holiday may not be enough to cover the extra labour. Better to eat the fixed costs than fixed costs plus labour X 1.5.

We were open regular hours all weekend, and every other day for that matter, and got rocked. Business volume made up for the stat.

The thing is, it's labour x1 even while closed for full-time and many part-timers (if you have worked on 15 of the last 30 days prior) anyway. They get the stat pay while you are closed.

I think that most businesses either don't give full time hours so stat pay doesn't exist or they only pay 1x for the stat but give another day off in lieu. Closing then saves labour costs.

It exists for full or part-timers, you just have to have worked ANY hours in 15 of the last 30 days.

or they only pay 1x for the stat but give another day off in lieu. Closing then saves labour costs.


That doesn't make sense either. If it is easy for employers to give employees days off in lieu wherever they want, why not do that all the time, ie. save labour often. Also, if they are only paying employees 1x working on the stats, whether they be full or part-timers, they are breaking the labour law. They have to give them 1.5x PLUS the day off later.

You should go to these businesses and publicly scold them for not living up to their capitalist obligations.

Here's the work around:

Substituting another day for a statutory holiday
48 (1) An employer may for one or more employees at a workplace substitute another day off for a statutory holiday if the employer and the employee or a majority of those employees, as the case may be, agree to the substitution.

(2) Any employees affected by the substitution of another day for a statutory holiday have the same rights under this Act and their employer has the same duties under this Act as if the other day were a statutory holiday.

(3) An employer must retain for 2 years records of agreements made under subsection (1).

... if the employee's regular schedule is Monday to Friday, change the stat to Sunday. They don't work but will get paid an average day's wage for it. They then work on Monday. For them, Monday is not a stat (Sunday was) so there is no need for time and a half and no need for the extra paid day.

Stats are incredibly expensive to pay staff for. It's easy to see the merit in closing on those days. Sure you still gotta pay for the day but it saves you the 1.5 on the day. Stat pay is essentially 2.5 times.

What I was suggesting by part time was 2-3 days a week and not 4 hours 5 days a week. On that basis you don't owe anyone a stat.
