If even this project ends up dead on the water I will become a density extremist. I will find like-minded people and stack ourselves on top of each other in a Rockland frontyard. There is no other way.

Haha I know it seems bizarre that a location like this can't take townhouses. I agree with you, if it is denied, we are essentially saying no where in the area is good for townhouses.

 

We are off to Council in January so we'll see how it goes.

Is this the Aryze proposal that has white bicycles and sandwich boards chained to public bike parking by the Janion and the head of the Galloping Goose? I think putting advertisements on public land like this is despicable and I hope you get fined.

Well, anyone who's a cyclist looks at a white bike and thinks that someone has been killed on their bike in that location. So, putting up an ad with a white bike is akin to using an AR-15 to advertise your preschool. It's shockingly tone-deaf.

The City of Victoria is being sued over the decision to approve this project. A Fairfield resident is asking the BC Supreme Court to overturn the approval based on height concerns and contravention of the community plan: https://www.timescol...ject-1.23969871

I don't understand John Wells' rationale for the court case.

 

The OCP clearly states certain buildings can be up to three storeys along secondary arterial roads. Is there anything in the Fairfield Community Plan that explicitly prohibits three storeys on this specific site?

Also, I assume construction can proceed at the site before the lawsuit is heard because there has not been an injunction granted?

The Fairfield Plan is in draft form, here is the latest version (.pdf)

Consider development of 3 to 4 storeys, with some added floor space, where the
provision of non-market housing is considered. In support of this goal, buildings
of up to 5 storeys may be considered along Fairfield road,

 

 

So I guess it comes down to whether you believe 1720 Fairfield is close enough to be considered part of the Fairfield Plaza urban centre.

 

I just can't see a judge looking at these documents and saying a three storey building is explicitly forbidden. 

 

The spirit of both the OCP and Plan hinge on preserving SFD neighbourhoods by densifying urban hubs. A border case like this has a lot of room for interpretation and I don't understand how a court can resolve it.

he actually lives about 6 or 8 houses up st. charles from fairfield.  not seriously affected certainly not next door.

^I take it his concern is if you allow this building outside an urban centre, there's nothing stopping council from allowing similar buildings marching all the way down the street.
