Langford man breached conditions by employing women

Kyle Mostowy was under a condition not to employ a woman in his business or supervise a woman in any capacity after he won the right to a new trial following a conviction for sexually assaulting an employee.
He has been convicted in a previous trial of five counts of sexual assault against five female employees, resulting from incidents in 2010 and 2011. He received a three-year sentence in this case.
Judge David Silverman determined text messages between Mostowy and the women corroborated the women’s assertion that they had an employment relationship with Mostowy, leaving him “in no doubt that Mr. Mostowy interacted with both M.A and S.O. as his employees.”

Woman who reported sexual assault inside store says Victoria mall responded negligently
A mother and daughter are claiming negligence by Mayfair Shopping Centre and a store located inside it, Epic Menswear, after the daughter says she was sexually assaulted by an employee.
On Dec. 15, 2024 – a woman went to Mayfair Mall to find Christmas gifts and to look for prom dresses.
Inside the store, she says an employee took her to the back changerooms to try on a dress shirt.
“Instead of giving it to me to try on he had put it over top – like, put it on for me – and he was feeling my body and stuff. Afterwards, he had taken it off and I like ran away,” she said.
“The suspect was arrested and set to be released with a future court date. However, they were held in custody under the Immigration Act and transferred to the CBSA (Canadian Border Services Agency),” said VicPD in a statement.
“While the investigation into the sexual assault was underway, we were informed by the CBSA that the suspect had been deported”.
CHEK News asked Epic Menswear about the suspect’s legal employment status at the time of the alleged incident, and how they’re addressing the situation with the victim.
The company said it would not comment at this time.

'This accused deserves better:’ frustration voiced in Nanaimo court with few supports for mentally ill offenders

NANAIMO — Arguably the city’s most prolific criminal has complex challenges with no apparent resolution currently available for society or the offender in question.

Aiden David Tye, 39, has over 165 criminal convictions since 2005, including nearly 80 for violent crimes with a vast majority of the offences occurring in Nanaimo.
Tye’s latest sentence was just shy of 18 months of new jail time after they pleaded guilty to six offences for crimes last year in Nanaimo and while in custody at Vancouver Island Regional Correctional Centre in Saanich.
Tye, who now identifies as a transgender woman, has diagnosed mental health conditions, including borderline personality disorder, autism, ADHD and stimulant use disorder.
Crown counsel outlined Tye’s offences included three separate incidents of assaults against correctional officers in Saanich.
The Nanaimo crimes involved Tye damaging patio furniture outside a coffee shop while an assault charge was stayed.
Defence lawyer Wright believes Tye should meet the criteria of an NCRMD offender (not criminally responsible due to mental disorder).

Multiple charges have been approved in court against three Port Alberni men accused of sexual offences on minors.
The Port Alberni RCMP's General Investigation Section (GIS) began an investigation in 2020. On January 7, 2025, charges were laid against Shaun Pater, Terrance Houbregs and Wayne Moore.
Shaun Pater was charged with 15 counts in relation to sexual offences on minors including trafficking of persons under the age of 18 years. Terrance Houbregs and Wayne Moore are charged with 6 counts involving sexual offences on minors.
All men are bound by several conditions which include the following:
• Not to have contact or communicate directly or indirectly, or be in the presence of anyone under the age of 16 years;
• No go to any public park or swimming area, community centre, theatre, where persons under the age of 16 years are known to be present;
• No to go to any daycare centre, school or playground.
Police want to remind the public that a sexual assault complaint can be made at anytime. If you are a victim of sexual assault please call us.
This matter is now before the courts, no further updates will be provided.

31-year-old sentenced in Port Alberni killing

A 31-year-old man has been sentenced for fatally stabbing a 42-year-old man in Port Alberni, above Port Pub on Oct. 20, 2023.
A fight erupted between Dylan Hamilton-George and Johnny Sorensen, with Sorensen the aggressor.
Hamilton-George stabbed Sorensen in the chest, who ran back into his apartment and returned with a sword, but collapsed before he could strike back.
Hamilton-George was initially charged w/murder but ended up pleading guilty to manslaughter.
The judge agreed with a joint submission of two-years-less-a-day, followed by three years' probation.
Taking into account time served he was sentenced to a further 88 days in jail.

Five Nanaimo businesses hit with ‘smash-and-grabs’

Five downtown Nanaimo businesses incurred vandalism and stolen property for some between Dec. 25 to Jan. 15, 2025.
-In December, Carnivore Kingdom, a pet supply store at 154 Cliff St., had several items stolen including a drawer of cash, according to RCMP.
Police searched with dogs and after clearing the building, no suspects were found inside.
-A classroom window was smashed at the École Pauline Haarer Elementary School on Jan. 10, 2025.
Suspects “may have been scared off by the alarm sounding before they could grab any of the items in the classroom.”
-At 6:54 p.m. on Jan. 13, 2025 the owner of Bees Knees Cafe & Catering, located at 525 Third Street, reported watching live on their cameras as a man broke into their business.
At approximately 2:25 a.m. on Jan. 13, 2025 a witness said “he could hear prying sounds coming from a street-level business located nearby,” according to RCMP.
-Police arrived at the Vancouver Island Refillery, located at 409 Fitzwilliam Street and found the front door had been removed.

Man With Imitation Firearm Arrested At Hillside Shopping Centre

Victoria, B.C. – A man was arrested at Hillside Shopping Centre yesterday afternoon after being seen carrying what appeared to be a real firearm, prompting a resource-intensive, high-priority response. The suspect, who was in breach of court-ordered conditions and had outstanding warrants, was prohibited from possessing weapons or being at the shopping centre. Duane Gerrad has been charged with one count of Carrying a Concealed Weapon, one count of Possessing a Weapon for a Dangerous Purpose, one count of Failing to Comply with a Release Order and one count of Failing to Comply with a Probation Order.
On January 19, just after 3:30 p.m., VicPD received a report of a male with what appeared to be a handgun tucked into his waistband as he entered Hillside Mall. Due to the high volume of civilians in the area and the potential threat posed by a real firearm, this was deemed a high-risk situation, prompting a priority response from several VicPD officers.
Gerrad was located inside the mall and arrested without incident. Once in custody, the firearm was seized and determined to be a pellet gun. This incident highlights the ongoing concern posed by replica firearms, which officers continue to encounter in the course of their duties.
Gerrad is being held in custody pending a court appearance later today.

Father testifies son, accused of murdering mother in Langford, was ‘unstable’

Ryan Elder’s father, Rick Elder, described him as a “happy little kid”. As a teen, Ryan was interested in cadets, computer games and rugby. As an adult things changed.
Crown portrayed Ryan as self-centred, manipulative, angry, and volatile. Rick acknowledged Ryan was a know-it-all and “unstable.”
Texts from the victim allege an increase in Ryan’s abuse, her pleas for help and a sense of helplessness.
In October 2021, she said Ryan was arguing about things that didn’t make sense, wasn’t taking meds, and not eating. “I don’t feel safe in my own home because of Ryan,”.
Defence is arguing that when he killed his mother, he was suffering a mental illness that made him incapable of appreciating the nature, quality and consequences of the act.

‘Awful, egregious:’ Parksville child **rn collector phoned police to turn himself in

NANAIMO — A Parksville man pleaded guilty to possessing over 1,300 images and 10 videos depicting the graphic sexual abuse of children.

A joint submission suggested four months in jail followed by 30 months probation for James Lucas Young, 31, in relation to a December 2022 incident in Parksville, with Young self-reporting his crimes to police.
Videos seized included images of children “between three and eight, being sexually assaulted by adults.The descriptions of the random samples are awful, egregious."
Young phoned 9-1-1 on Dec. 27, 2022, at 3:40 a.m., saying he wanted to turn himself in.
A search warrant uncovered multiple computers/devices, which Young freely provided investigators access to.
Young: “The affectionate humanity that I’ve been shown since the beginning, everyone from the officers who I first encountered to my lawyer, and the Crown prosecutor, you yourself Your Honour, showed me a level of respect that you wouldn’t normally expect being to this, and I will forever be thankful for that.”
Judge Hodge decided to reserve her decision to review similar cases and sentences.

A sentencing hearing has wrapped up for two men found guilty in the fatal 2022 stabbing of a man with developmental disabilities.
Crown suggested 8 years would be appropriate for the two Nanaimo men, even though one sprayed the pepper spray while the other inflicted the fatal stabbing wound.
Both were found guilty of manslaughter.
29 year old Fred Parsons, who had developmental disabilities, was with two friends and his dog at the playground when Aiden Bell and Mark Harrison approached and aggressively started asking for information. Soon after one pepper sprayed them and the other stabbed Parsons.
Aiden’s lawyer argued a sentence of four to five years in prison was appropriate while Mark Harrison’s lawyer argued a sentence of four years was right.
Sentencing will be set on February 3rd.
