This Bill is being introduced that appears to give our Lieutenant Governor in Council (an un-elected representative of the queen) dictatorial powers without limitation while we are in a declared state of emergency (that has no checks or balances or any parameters to define it). It also absolves anyone in the government from liability in any of the shenanigans that have transpired. 

Am I reading this wrong?

The Lieutenant Governor in Council isn't the personage of the actual Lieutenant Governor.

 

It's only the mechanism by which the Executive Council of the Government (all elected) directs the LG as to what they want the LG to sign off on.

In other words, when the Provincial Cabinet makes a decision, and the LG signs off on it (which they always are obliged to do), the legislation is said to have been passed by the "Lieutenant Governor in Council".

In Canada, Provincial LG's aren't political by design.

 

So this legislation really just codifies what the Provincial Gov't can and can't do around the emergency health declaration - which is likely very necessary at this point in time, considering that there is only general language in existing legislation relating to "health emergencies" ... whereas now we're four months into a major, and unprecedented pandemic, currently without specific legislation designed to deal with the Provincial Governments response specifically to that pandemic.

 

So in short, it's B.C.'s elected Cabinet doing some much needed, very specific legislative housekeeping related to a world wide COVID-19 pandemic.
