probably. but if charges are sworn not sure it will make much difference. if they are not approved you can still report on a person being arrested. as we saw with the TC and the Earl Large story.

Capital Daily has achieved their objective of convicting him without a trial. It's the woke thing to do. I am sure they are fine with the outcome.

Charges have not been sworn, according to Capital Daily's update:

CORRECTION on October 3, 2021: An earlier version of this story said Wallace has been charged. The BC Provincial Court says no charges have been sworn on this file at this point. This story will be updated when and if this changes.

It’s not the media’s role to pre-empt due process, is it?

It shouldn't be.

If sexual assault charges are laid. I still can't find anything in the published accounts that would amount to that however.

As we saw here, the Capital report has already led to people drawing conclusions and 'convicting' the guy. I am sure that if he had any semblance of a business left it is now gone.

The Capital has now sent an email which sounds even different. Sounds like they ran the story without any confirmation from VicPD. Jimmy is an experienced reporter.

Good morning,

Yesterday morning we sent out a newsletter with the headline, "Driving school owner arrested and charged." That headline, and the accompanying newsletter item, was incorrect: driving school owner Steve Wallace has been accused of three counts of sexual assault, according to a police document, but contrary to our reporting, charges have not been sworn. (And as noted in the story, none of the accusations has been proven in court.)

VicPD has not yet responded to multiple requests for clarification on this story, but BC Court Services confirmed to us that our initial reporting was incorrect.
The story has been corrected on our website. We're sorry for the error, and we will continue to follow this story.

They are also glancing over the fact that they claimed he was released on bail. That never happened.

I do not believe it is VicPD's role to respond to unsubstantiated claims of charges and assumptions under the guise of clarification requests.

So... what actually happened?

The Daily seems to be where the woke turn to for their news. I get the sense they were salivating over the opportunity to take aim at someone even remotely representing 'big carbon'.

it would seem an odd time for VicPD to remain silent.  compared to their usual release of information on various files.

I am wondering now if the documents that the Capital claims to have from the police were obtained through proper channels. Seems unusual that the police would supply them and not then not answer any questions.

This is a tactic used a lot nowadays (by both sides): they know that he correction will only reach a small percentage of the people who heard about the accusations. Capital Daily are activists disguised as journos.

And presumably to take down another straight, white, male, settler.

Or if they were obtained at all. A 'document' nowadays could be an email, or a text message.

We still don't know if Wallace was arrested. Nothing has been corroborated by police.

that's a very good question.  who leaked the document?

also to spanky's repeated stance here, he is correct, this is the most defining thing we have ever heard about the allegations:

After Oye and others spoke out about their experiences in Capital Daily’s first investigation, more and more women came forward with their own stories. In total, we have spoken to more than 20 women who said they had been sexually harassed or sexually assaulted by Wallace.

All of them said he would repeatedly compliment their appearance, say “I love you”, and touch their leg, thigh, or hand during driving lessons. Some women say he pinched or rubbed their butt, and one says he leaned across and buckled her seatbelt during a driving lesson, running his hand across her chest in a way that immediately made her uncomfortable. In another incident, a woman—who was a teenager at the time—alleges that he instructed her to drive to his friend’s apartment and made her go in. She said he and his friend spent about 20-30 minutes complimenting her appearance, asking her to guess the cost of objects in the room, and laughing at her discomfort.

there is not too much damning in there except the "butt" pinching or grabbing part.  the other touching might be justified in in-car training.

In my opinion, what Jimmy needs to do is call his boss Andrew Wilkinson and have them engage with council.

i also do believe that VicPD rarely name the suspects they have arrested until the charges are formally registered.  they do not name the person in any random arrest.

but they could easily come out today and say they "arrested a suspect in a high-profile sexual assault case involving a local driving school/business" or similar vague wording.

Well the article still claims that they obtained undertaking documents. Interesting as this article seems to state that undertaking documents are not public. ACC-2 - Access to Court Records.pdf (provincialcourt.bc.ca)

The Capital has updated its article yet again. Now showing the letter of undertaking and claiming that Ms. Oye provided it to them.

Don't know if that helps or hurts their case. It clearly states that Wallace has been accused of sexual assault, nowhere does it state that he was arrested or charged.
