The Victoria Fire Department was called to the Gorge Waterway Sunday to help contain a diesel spill linked to a sunken boat.

The department dispatched its fireboat and the four-person crew discovered the diesel spill near the public dock at the foot of Styles Street off Banfield Park. -

It is over 5 1/2 years since the boats moved in.  Nothing changes despite the rezoning of the waterway and numerous complaints.

Helps calls it difficult because it's a private property issues. Helps is becoming an issue.

Honestly, the city should just go in, grab the boats and haul them out of the water, they have room in the city yard to store them, for free. If the owner shows up, have them show a "certificate of seaworthyness" or whatever. Those two boats that are underwater are obviously never going to go anywhere under their own power.

Sometimes you just have to step up and do something, not say "our hands are tied because it is a federal matter" etc. Just go in, do it, if you get sued, so be it, a judge will hear why you did it and if any damges should be awarded. If it is criminal "theft" by grabbing them and placing them on shore and drying them out, I don't think any judge would convict if you pulled it out of the water, made it more safe, dryed it out, made it more secure and safe from weather, provided reasonable access to the owner and charged no fee.

 

And this is what I said 5.5 years ago.

Has nothing happened since this August 2014 news?

I wonder what would happen if someone where to anchor their liveaboard boat in the Inner Harbour in front of the Welcome to Victoria sign?

Victoria council has taken another step toward removing derelict and liveaboard boats from the Gorge waterway near Banfield Park.

Following a public hearing last week in which several people on both sides of the issue spoke, Victoria councillors adopted a bylaw to rezone the waterway for recreational use only.

Liveaboards, float homes and overnight anchorage or moorage would not be permitted in the area.

The city still requires a licence of occupation over the waterway from the province before the bylaws can be enforced.

Fortin said the bylaw strikes a balance, like what has been done in parks bylaw which prohibits campers from pitching tents in playground areas or ecologically sensitive areas.

“We are not providing an outright ban of people mooring throughout the Gorge waterway or throughout the Inner Harbour or Upper Harbour or any of those places,” he said.

“We are directing our mind to something that’s been described as an extremely sensitive area.”

What would happen at the derelict and liveaboard area if the city were to take out a water lot lease such as the one that exists for the International Marina being built in the Inner Harbour?

Would they be able to enforce anything then?

Looks like there is a simple solution that is not being utilized.

The City of Victoria has been sitting on an offer to remove derelict boats from the Selkirk waterway for free, says a former councillor.

“It’s a lack of political will. [That] is what we’re witnessing here,” said Shellie Gudgeon, who is exasperated by the city’s seeming unwillingness to take action to remove the boats.

Helps' response is a joke. If they researched outstanding legal cases when the bylaw was passed then it should take only an hour for the legal department to check and see if there was anything new that occurred during the period of months that the City was waiting for the Province to grant them a lease.

 

No doubt Helps just doesn't want to take any action that could be perceived as her supporters as detracting from squatting rights.

There is at the very core of this issue the commitment from Mayor and Council to be open, engaged and transparent during their term of office. The letter has been in their possession for months. The ok from the Province to transfer rights to the water lot has been in their hands for months as has the by/law. The closed door discussions on this issue have been nothing short of establishing a 'red herring' of miscommunication. Acting on the issue is and has been a reality for months. Raw feces, garbage, diesel fuel, battery acid, and flagrant drug sales, all increasing in scope. Yet the will of the Mayor and Council remains flaccid in the face of challenges such as... "We will be displacing people who would become homeless." Person the pun, that's garbage. Over 20 of the illegally and polluting offenders are not occupied. Start with those vessels... Now!

It is the Mayor's support base. Look at her facebook page and 100% of the issues she discusses are related to homelessness.

 

What is interesting is that it appears as though her council fanclub (ie Loveday and Isitt) have largely been silent in recent weeks.

Surely she has pissed off enough residents by now that it would be relatively easy to get the required signatures.

The two boats in the top left are anchored right in front of the underwater cable sign that has a NO ANCHORING logo.

One of the boats is stacked with stuff on the deck will end up in the water during the next storm.

In front of that boat is a sunken vessel with only the bow showing.

The containment boom is there to contain any oil slicks.

And the situation remains...
