Major Crimes Unit investigating Oyster River hit and run

A busy Saturday afternoon at the Discovery Foods Plaza in Oyster River north of Black Creek was interrupted by a brazen hit and run.

CHEK News has been told the man and woman (following an argument)  walked to a bus stop across from the plaza then moments later as they crossed the road again, a silver car, believed to be a four-door Mazda travelling towards Highway 19A appears to have veered directly towards the pair, striking the man.

“At 1:30 yesterday afternoon we were called to an MVA with a pedestrian struck in front of the Discovery Foods store,” said Oyster River Fire Chief Bruce Green. “When I arrived on scene there was a gentleman who was lying on the road in some severe pain and had allegedly been hit by a vehicle that had left the scene.”

The woman was able to get out of the way but the man was hit and tumbled into the air somersaulting over the car. He landed about 15 metres down the road as the car took off.

There is extensive video surveillance at the plaza and it has been viewed by police. To date there have been no arrests.

Man who killed West Shore RCMP officer in drunk driving crash has statutory release reinstated

The man convicted of killing West Shore Mountie Sarah Beckett in a drunk driving crash in 2016 has had his statutory release reinstated.

Jake Fenton has been in custody since April, when his statutory release was cancelled due to failing a drug test for the second time.

Fenton has a prescription for medical cannabis to help manage anxiety, chronic pain and sleep issues.

In his most recent breach, however, meth and THC were found in his body. Fenton reportedly consumed the substances when he ate an edible that he says he thought only contained cannabis.

The edible was given to him by a friend, even though Fenton is only supposed to consume marijuana that comes from legal streams.

Fenton had his statutory release reinstated with two new conditions, including attending one-on-one counselling and avoiding negative associates.

Man Arrested After Impaired Driver Points Handgun At Other Driver

 

Date: Monday, June 20, 2022 - File: #22-22729

 

Victoria, BC – Patrol officers arrested a man and seized a pellet gun after he pointed a handgun at a father on his way to meet his daughter for breakfast Saturday morning.

 

Patrol officers were initially called to the intersection of Douglas and Finlayson streets for a report that a driver had pointed a handgun at another driver. At approximately 9:45 a.m., a man reported that he was driving on his way to meet his daughter for breakfast Saturday morning near that intersection when another vehicle began driving dangerously in front of him, “brake-checking” him and preventing other traffic from passing. As the man passed the vehicle, the driver began yelling and pointed a handgun at him. The man immediately left the area, got to a safe location and called 911. While leaving the area the man took photos of the suspect vehicle with his mobile phone, which he then shared with officers.

 

Armed with these photos, officers began to search for the suspect vehicle and driver.

 

A short time later, officers received a call that a vehicle was parked in front of a business in the 3000-block of Shelbourne Avenue and that the driver was displaying signs of being impaired. The description of this driver and vehicle matched the description of the driver in the previous incident. Officers attended and arrested the man at gunpoint.

 

Officers searched the car and recovered a fully-functional pellet gun which resembled a high-calibre handgun, as well as drugs and drug paraphernalia. Officers conducted a standard field sobriety test, which the driver failed. He was transported to VicPD cells for additional drug-impaired driving investigation. Officers also noted several deficiencies in the vehicle which made it unsafe to be on the road.

 

The driver of the vehicle was released with conditions and a future court date for recommended charges for pointing a firearm and impaired driving. He was also issued a 24-hour driving prohibition, tickets for traffic offences and offences under the Cannabis Act, as well as Notice and Orders to repair the vehicle deficiencies. The vehicle was towed to impound. No one was physically injured in these incidents.

Lawyer for Andrew Berry argues jury heard evidence they shouldn’t have during appeal

Berry’s lawyer, Timothy Russell, argued the judge failed to hold a voir dire for some of the evidence, which according to B.C.’s Ministry of Public Safety and Solicitor General, is a hearing without jury present to determine the admissibility of evidence.

The first piece of evidence was Berry saying “leave me alone, kill me” when paramedics and firefighters first found him. Russell argued these comments required more context, including who Berry thought he was talking to and their potential power of authority that could influence a confessional statement.

The second piece of evidence was when Berry was waking from surgery and reportedly mouthed the words “kill me” to a nurse. Berry’s lawyer says she was in a position of medical power and therefore unable to receive a reliable confession.

The third piece of evidence was the handwritten notes between Berry and his sister, who is an RCMP officer. The trial judge treated her role as a police officer and her relationship with Berry as mutually exclusive. Berry’s lawyer called that a palpable and overriding error because of the risk of potential abuse of power, like using familial emotional triggers not accessible even to police, to get someone to speak or possibly confess.

Later in the day, Russell argued that when Berry was in the hospital receiving treatment for his own injuries, the police didn’t adequately advise him of his right to silence, and therefore anything that was said during that time should have been inadmissible.

Woman found dead in south Nanaimo, one arrested

Nanaimo RCMP officers were called to a home on Eighth Street, near Park Elementary School, at around 10 p.m. on June 20 after receiving a report about a disturbance.

According to a Nanaimo RCMP press release with very little information, once officers entered the home, they found a deceased adult woman and a short time later arrested a male suspect for murder.

“That individual is in custody … and no charges have been laid at this point,” he said.

“At this point, we don’t believe there is any further risk to the public,” he said. “We are not releasing any further information on this as well because it is very early in the investigation.”

Canadian couple found murdered in Mexico resort town of Carmen del Playa

Male victim was wanted internationally for fraud, say authorities

Two Canadian citizens, a man and a woman, have been killed at the beach resort of Playa del Carmen on Mexico’s Caribbean coast, authorities said on Tuesday.

A senior state official told Reuters the man, whose identity has not been made public, was wanted by Interpol.

“He was not a tourist,” the official said, adding that the man had been in hiding in Mexico for about four years. Local papers have identified the man as a Quebec native who first entered the country in 2016.

Investigators searched the apartment where the bodies were found and discovered the male victim had IDs with three different names.

Mexican media said the victims had had their throats cut, citing a local police report. 

Murders in the resort state have nearly quadrupled since 2016, to about 37 per 100,000 residents.

Wanted Man Franklin Cook Arrested

Victoria, BC – VicPD officers have arrested Franklin Cook, who was wanted on a Canada-wide warrant after failing to return to his community-based residential facility in Victoria.

 

Franklin Cook is serving a more than five-year federal sentence for armed robbery, disguise with intent, break and enter, and administering a noxious substance.

 

Officers located Cook after stopping to check on a man sleeping on the street and took him into custody without incident. He has been transferred to the custody of Corrections Canada. Thank you to everyone who shared his information.

Two taken to hospital following double-shooting in Campbell River

A double-shooting took place in Campbell River on Tuesday afternoon.

The shooting reportedly took place at Robron Road and Upland Drive, according to witnesses.

The spokesperson said both patients were taken to hospital but would not comment on their injuries or whether there were any fatalities.

CHEK News has reached out to the Campbell River RCMP and BC Coroners Service for more information but has not received anything at this time.

Oak Bay father had right to silence, which is not evidence of guilt: defence lawyer

An Oak Bay father’s failure to ask about his two young daughters who were murdered on Christmas Day 2017 should never have been admitted as evidence during his trial, his lawyer said Tuesday.

The Crown put Andrew Berry’s silence forward as evidence of his guilt, Tim Russell told the B.C. Court of Appeal on the second day of a four-day hearing in Vancouver.

Berry, who was recovering in hospital from what the Crown called a self-inflicted throat injury, had a right to silence, Russell argued.

“It should have been ruled inadmissible from the get-go,” he said.

Although the trial judge told the jury to put that information out of their minds, prejudice was being built up throughout the trial and was propelling them to a conviction, said Russell.

Justice Miriam Gropper’s charge to the jury on the issue of Berry’s suicide attempt was “deficient,” said Russell.

A suicide attempt is a sign of a diminished mental state and the judge did not tell the jury to take his condition into account, said Russell.

The judge also erred when she told the jury to disregard defence evidence of third-party suspects, he said. She told them to disregard an unsolved knife attack that had taken place six months earlier on the Esplanade by Willows Beach.

The judge also refused to let the defence put the girls’ mother, Sarah Cotton, forward as a third-party suspect.

One woman is in hospital and a man is dead after a shooting Tuesday in Campbell River, RCMP said.

The man’s death appears to have been caused by a self-inflicted gunshot wound, police said.

Police have asked people to avoid discussing or posting photos about the incident on social media in order “to allow families to have time to process and privately grieve.”

Nanaimo man charged with murder of Victoria woman

Mounties say a 21-year-old man from Nanaimo, B.C., has been charged with second-degree murder in the death of a woman from Victoria.

Police were called to a home in south Nanaimo for reports of a disturbance around 10 p.m. Monday.

On Wednesday, police identified the victim as 40-year-old Denise Allick, and the suspect as 21-year-old Simon Baker.

Mounties say it's unclear why the Victoria woman was in Nanaimo, and what the relationship was between the two individuals, if any.

Port Alberni RCMP are investigating a suspicious death at a city motel.

 

Police received a report at 6:19 p.m. Saturday that a man had sustained significant injuries at a motel on Redford Street. He died at hospital.

Increasing lawlessness in Victoria’s downtown

 

Harm to persons and property caused by “undesirables” habituating the downtown core of Victoria makes attendance to the area less and less attractive.

 

Who wants a machete-wielding, mentally ill, drug-dependent stranger threatening them?

 

Who wants to own a business where “street people” feel they are entitled to shoplift with impunity?

 

Who wants to be an arresting police officer writing reports and spending court time only to see persons “known to them” with hundreds of prior arrests walk out the door only to cause yet more crimes against the community?

 

Who wants to give up stewardship of our once safe and beautiful city centre?

 

It seems to me that the only way to take back the streets is to remove the bad actors from mix. How can we accomplish that without denying them their constitutional rights?

 

What is so cruel and unusual about moving those that cause 80 per cent of the problems to a place where they would be housed and fed and, hopefully, rehabilitated?

 

The habitual criminals clearly deny ordinary people of their constitutional rights, so what’s so bad about denying them the opportunity to cause more harm?

 

It seems to me that constitutional rights should be coupled with constitutional responsibilities. If one deprives another of his rights then his own rights will equally be forfeit.

 

If that were the case our police and law-abiding citizens could see a light at the end of the tunnel.

 

Until some basic constitutional changes are made about responsible conduct, the situation will only get worse.

I was about to say, all this teeth-gnashing and pearl-clutching about the horrors of downtown YYJ, but the real action is taking place in Nanaimo, Campbell River, Port Alberni, Black Creek etc...
