I must have missed the judge's ruling on this.... Is anyone aware of the court's decision?

 

The judge reserved his decision, I can't find anything indicating when the decision will be made or if it already has been

The decision has been made (finally) by the judge. He's given the city the go-ahead:

and now they can move into freshly built low income housing at the Tally Ho, Mt Edwards, etc, etc  :whyme:

 

Don't worry boaters, if those units are full they will just build more

Some kind of other deadline has passed again.

 

14 boats remain, although a couple have been "signed over" to the City.  YES, we own some boats!

 

The City has to go back to court to get an enforcement order if the dozen do not move.

As of this morning May 8, only 11 boats are still moored.  That's from a high of 21 last summer, and an average of 16 through the winter.

 

These two compounds look like they're building their battlements in preparation for the impending eviction (if it ever comes).

A vessel moored off Bamfield Park caught fire in the early morning hours.

A vessel moored off Bamfield Park caught fire in the early morning hours.

 

It is only a matter of time before one of the boats on fire is attached to the Selkirk Trestle.

But there doesn't seem to be any "teeth in the matter" as we have discussing it in this thread since 2010.

As of June 2, only 5 boats remain. Over the last week or so several of the boats were towed out, including the two large floating "docks" pictured in my previous post above.

The only difference from then to know is possibly squatter(s) in the small boat. I rode by on my bike yesterday and stopped because I thought I could hear the voices of two people. But I couldn't be sure.

I'm a bit ignorant of the laws regarding vessels but what is stopping a citizen from bringing a trailer and taking one of these out of the water for claim? What's the process if any?

Maritime salvage law.....you "rescue" the vessel you are entitled to reward commesurate with the value of the vessel.

I got curious and looked it up. It falls under the Canada Shipping Act, 2001. One can take posession but to take ownership or to salvage requires going through a process with Transport Canada.

If I had time and money, I would investigate the larger vessel. It looks salvageable but I know little about boats. I'm the Mr. Mole to someone's Ratty.

I believe both the of the boats closest to the Galloping Goose bridge over the Gorge are now occupied. Heard something like a gas powered motor/generator(?) from the small while cycling by yesterday and saw a man on the back deck of the larger. I'm leaning towards squatters for the small boat but salvager for the large?
